GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale (hereinafter the “General Conditions”) apply to all purchases made by an internet user / individual (hereinafter the “CUSTOMER”) on the website www.Jyoko.com (hereinafter the “WEBSITE”) from Jyoko Europe S.L., a limited liability company registered in the Barcelona Mercantile Registry under No. B‑66620683, headquartered at Carrer dels Esqueis, S/N, Nave 10, 08415 Bigues i Riells, Barcelona – Spain, with VAT number ESB66620683, Spanish telephone: 933363565, email: info@Jyoko.com (hereinafter the “SELLER”).

IMPORTANT
Every order placed on the WEBSITE necessarily implies the CUSTOMER’s unreserved acceptance of these General Conditions.

Article 1.    Definitions

The terms used below have the following meanings in these General Conditions:
  • “CUSTOMER”: denotes the SELLER’s contracting party, who guarantees to qualify as a consumer as defined by Spanish law and jurisprudence. It is expressly stipulated that the CUSTOMER acts outside any professional or commercial activity.
  • “DELIVERY”: means the first delivery of the PRODUCTS ordered by the CUSTOMER to the delivery address specified in the order.
  • “PRODUCTS”: refers to all products available on the WEBSITE.
  • “TERRITORY”: refers to SPAIN.

Article 2.    Purpose

These General Conditions govern the sale by the SELLER of PRODUCTS to its CUSTOMERS.

The CUSTOMER is clearly informed and acknowledges that the WEBSITE is directed at consumers, and professionals must contact the SELLER’s commercial department to benefit from specific contractual terms.

If the CUSTOMER does not accept these terms, please refrain from using the WEBSITE.

Article 3.    Acceptance of the General Conditions

The CUSTOMER agrees to read carefully and accept the General Conditions before proceeding to payment of the order.

These General Conditions are linked at the bottom of every page on the WEBSITE and must be consulted before placing an order. The CUSTOMER is invited to read, download, and print them and keep a copy.

The SELLER recommends reviewing the latest version of the General Conditions at every new order.

By clicking first to place the order and then to confirm it, the CUSTOMER acknowledges having read, understood, and accepted these General Conditions in full.

Article 4.    Purchase of Products on the WEBSITE

In order to purchase any PRODUCT, the CUSTOMER must be over 18 years old and legally capable—or if a minor, able to justify consent from legal guardians.

The CUSTOMER is invited to provide necessary identification information via the online form. Fields marked with (*) are mandatory to process the order. The CUSTOMER can track the status of their order on the WEBSITE. Shipment tracking may be available online from certain carriers.

The CUSTOMER may also contact SELLER’s commercial service via email (info@Jyoko.com) to obtain order status updates.

The information provided must be complete, accurate, and up to date. The SELLER reserves the right to request confirmation of identity or other details by any appropriate means.

Article 5.    Orders

Orders for PRODUCTS may be placed via our website.

The ordering process follows these steps:

Store → Click on the product → Add to Cart → Continue adding products → View Cart → Click Next → Register or continue as guest → Delivery details → Delivery method → Payment method → Confirm order → Pay → Complete purchase

Once the purchase process is successfully completed, you’ll receive a confirmation email with the reference number identifying your order and a summary of your purchase. Please review and keep it as proof of purchase.

Article 5.1. Characteristics of the PRODUCTS

The SELLER will aim to present clearly the main characteristics of PRODUCTS and all mandatory information required by applicable law.

The CUSTOMER agrees to carefully read such information before ordering.

The SELLER reserves the right to modify the selection of available PRODUCTS depending on supplier issues.

Unless explicitly stated otherwise, all PRODUCTS sold are new, compliant with current European legislation and applicable Spanish regulations.
Article 5.2. Order procedure

Orders are placed directly on the WEBSITE. To order, the CUSTOMER must follow the steps below (may vary slightly depending on browser).

5.2.1.    Selection of PRODUCTS and purchase options.
The CUSTOMER selects the desired PRODUCT(s), chooses quantities and options, which are placed in the shopping cart. Additional PRODUCTS may be added.

5.2.2.    Orders
After selecting PRODUCTS, the CUSTOMER verifies the cart, then logs in or registers if not yet done. The online form will present price, taxes, and delivery costs. CUSTOMER must verify all details before validation.

CUSTOMER proceeds to payment, providing all billing and delivery information. Specific references appear when options are selected. Delivery method must also be chosen.

5.2.3.    Order acknowledgment
After completing the aforementioned steps, an on‑screen acknowledgment appears and a copy is emailed automatically to the CUSTOMER, provided the email address is correct. No postal or separate confirmation is sent.

5.2.4.    Invoicing
CUSTOMER supplies billing information; fields marked (*) are mandatory. CUSTOMER must also provide delivery address and access codes if needed. Neither the online acknowledgment nor the email confirmation constitutes an invoice. The original invoice is enclosed in the package upon delivery.

5.2.5.    Discounts on orders
Discounts are not cumulative, and only one may apply if permitted. For example, a 5% newsletter discount cannot combine with free‑shipping offers. The SELLER reserves the right to withdraw any offer at any time.
5.3. Date of the order

The order date is when the SELLER acknowledges receipt online. Timelines on the WEBSITE begin from that date.

5.4. Price

All PRODUCT prices are shown in euros, VAT included, plus delivery costs based on weight (excluding packaging and gifts), delivery address, and chosen carrier. Prices include VAT at the rate applicable on the order date. Changes in VAT rates may be passed on from their effective dates.

Supplier cost changes or special offers may alter prices. The price applicable is that shown on the WEBSITE at the time the order is placed.

Orders placed outside the EU, Canary Islands, Ceuta, Melilla, and Andorra are the CUSTOMER’s responsibility for all associated duties and taxes under applicable law. The invoice amount in euros will be declared for customs. Customs duties vary per country and must be paid in cash on receipt. Such international orders are invoiced VAT‑free.
5.5. Availability of PRODUCTS

The SELLER manages inventory on a “just-in-time” basis. PRODUCT availability depends on stock. If unavailable, this should be indicated on the PRODUCT’s page and the CUSTOMER notified. If not indicated, the SELLER must inform without delay.

Options offered: ship all together when all items in stock; ship available items first and remaining later (notifying any extra transport costs); propose a similar alternative product if accepted by the CUSTOMER.

If the CUSTOMER cancels unavailable items, a refund will be made within 30 calendar days of payment.

Article 6.    Right of Withdrawal

The terms of the right of withdrawal are set forth in the “withdrawal policy”, available in Annex 1 to these General Conditions and accessible via hyperlink on every page of the WEBSITE.

Article 7.    Payment

Orders are dispatched after payment is received and identified. Payment methods: Redsys – Credit/Debit Card: VISA, MASTERCARD, AMERICAN EXPRESS;

  • PAYPAL – VISA, MASTERCARD, AMERICAN EXPRESS
  • Bank Transfer:
    "Spanish Payment Services Law sets one business day as the maximum time for a transfer to clear. This may require a longer wait if the transfer is made before a weekend or holiday."

All payment details will be provided in the confirmation email.

7.1. Payment Methods

CUSTOMER may pay via the methods offered. CUSTOMER guarantees to have authorization for the chosen method. SELLER takes necessary measures to ensure payment data security. Payment data is transmitted to the bank and not processed on the WEBSITE.

7.2. Date of Payment

For single credit card payments, the CUSTOMER’s account is debited at the time of order. For partial delivery, the full amount is debited when the first package is shipped. If CUSTOMER cancels unavailable items, refunds follow Article 5.5.

7.3. Delays or Payment Rejection

If payment is declined, CUSTOMER must contact SELLER to choose another valid payment method. If payment cannot be completed for any reason, the order is canceled and sale automatically rescinded.

Article 8.    Proof and Record-keeping

Contracts for orders over €120 (VAT included) will be archived by the SELLER for five years. SELLER agrees to keep information to ensure follow-up and provide a copy to CUSTOMER on request. In case of dispute, electronic records may be used to prove transaction integrity.

Article 9.    Transfer of Ownership

OWNERSHIP remains with SELLER until full payment is received. However, risk of loss or damage passes to the CUSTOMER upon receipt of the PRODUCTS by the CUSTOMER or a designated third party other than the carrier.

Article 10.    Delivery

Delivery terms are set out in the “delivery policy” in Annex 2, accessible by hyperlink on every page of the WEBSITE.

Article 11.    Packaging

PRODUCTS will be packaged according to applicable transport regulations to ensure maximum protection during delivery. CUSTOMER agrees to respect these standards when returning products under the withdrawal policy (Annex 1).

Article 12.    Guarantees

12.1. Guarantee of conformity.
SELLER undertakes to deliver a PRODUCT that conforms to its expected use, matching the WEBSITE description. It must have qualities legitimately expected from public declarations including promotion and labeling.

Conformity issues apparent at delivery or due to packaging, assembly instructions or installation (if carried out or commissioned by SELLER) are covered.

Claims for non-conformity must be made within two (2) years from delivery.

CUSTOMER may request repair or replacement; if disproportionate, SELLER may issue a refund.

If replacement or repair is impossible, SELLER will refund the price within 30 calendar days upon receipt of returned PRODUCT at Carrer dels Esqueis, S/N, Nave 10, 08415 Bigues i Riells, Barcelona – Spain.

CUSTOMER is exempt from proving defect for six (6) months from delivery. This legal guarantee applies independently of any commercial guarantee.

12.2. Hidden defects guarantee.
SELLER guarantees hidden defects that render the PRODUCT unfit for its intended use or diminish it significantly. CUSTOMER may choose between refund or partial refund.

If repair or replacement is not possible, refund will be made within 30 calendar days after return.

Claims for hidden defects must be made within two (2) years from discovery.

Article 13.    Liability

SELLER’s liability is excluded for non‑performance caused by CUSTOMER. SELLER is not liable for delay or non‑performance due to force majeure or unforeseeable events as defined by Spanish courts.

SELLER is not responsible for websites linked directly or indirectly; hyperlinks are provided for convenience only.

A cookie is a file downloaded to your device when accessing certain web pages. Cookies allow a website to store and retrieve information about browsing habits, and can identify the user.

This WEBSITE uses first‑party and third‑party cookies.

Article 16.    Intellectual Property

All visual and audio elements of the WEBSITE, including underlying technology, are protected by copyright, trademarks, or patent rights and are the exclusive property of the SELLER.

Anyone wishing to edit a webpage and create a direct hyperlink to the WEBSITE must obtain written authorization. Such links are revocable at SELLER’s request; framing or in‑line linking is strictly prohibited.

Article 17.    Validity of the General Conditions

Any legislative or regulatory changes, or court decisions invalidating one or more clauses, do not affect the validity of the remaining provisions.

Such changes or decisions do not entitle CUSTOMERS to disregard the General Conditions. All matters not expressly covered here are governed by common trade practices between private individuals.

Article 18.    Amendments to the General Conditions

These General Conditions apply to all online purchases made while the WEBSITE is available.

They will be precisely dated and may be modified and updated by the SELLER at any time. The version in force at the time of order applies.

Changes do not apply to PRODUCTS already purchased.

Article 19.    Jurisdiction and Applicable Law

THESE GENERAL CONDITIONS AND RELATIONS BETWEEN CUSTOMER AND SELLER ARE GOVERNED BY SPANISH LAW.

IN CASE OF DISPUTE, ONLY SPANISH COURTS ARE COMPETENT.

Before arbitration or court proceedings, parties should negotiate in good faith to reach an amicable agreement. The initiating party must send a certified letter specifying the conflict. If no resolution is reached within fifteen (15) calendar days, differences will be submitted to competent jurisdiction.

During negotiation, legal action is prohibited except for precautionary measures; initiating proceedings does not waive amicable agreement except by express contrary intention.

ANNEX 1

WITHDRAWAL POLICY

Withdrawal period

The withdrawal period expires thirty (30) calendar days after the day on which the CUSTOMER, or a designated third party other than the carrier, takes possession of the PRODUCT.

If multiple PRODUCTS are delivered separately, the period expires thirty (30) calendar days after possession of the last PRODUCT delivered.

Notification of withdrawal

To exercise withdrawal, the CUSTOMER must notify their decision via an unequivocal statement (e.g. letter, fax, or email) to Jyoko Europe S.L., Carrer dels Esqueis, S/N, Nave 10, 08415 Bigues i Riells, Barcelona – Spain; info@Jyoko.com; phone 933363565.

The withdrawal form may be used, though it is not mandatory.

Communication must be sent before the withdrawal period expires.

Effects of withdrawal

If the CUSTOMER withdraws, they assume return shipping costs. The return must occur within 30 calendar days of purchase.

SELLER will refund using the same payment method unless CUSTOMER agrees otherwise, with no cost to the CUSTOMER.

Refund may be delayed until receipt of the PRODUCT or proof of dispatch, whichever occurs first.

Return procedures

CUSTOMER must return the item within thirty (30) calendar days of withdrawal notification to the address above.

Return costs

CUSTOMER bears direct return shipping costs.

Returns for promotional or free-shipping items
Partial returns result in loss of applied discount; discount will apply only to the retained items. Shipping fees are non‑refundable for returned items.

Gift card terms:
1. Gift cards valid only for purchases on Jyoko website.
2. Unused gift cards may be refunded within 14 calendar days of shipment to recipient. Refund will be made to original payment method.
3. Gift card balance cannot be redeemed for cash, only products.
4. If items paid partly with gift card and partly by other method, the gift card portion will be refunded to gift card balance; the rest will go back to the original payment method.

Personalized products:
• Price may vary depending on design.
• Not eligible for return or exchange.
• One extra day added to average delivery time, depending on delivery country/zone.

Condition of the returned item

CUSTOMER is not responsible for depreciation resulting from normal use, but will be if misuse beyond ordinary handling occurs.

Packaging

Must follow appropriate standards when returning.

Exclusion of withdrawal right
The right of withdrawal does not apply to:
  • Services/goods whose price depends on financial market fluctuations.
  • Goods made per customer specifications or clearly personalized.
  • Perishable or rapidly expiring goods.
  • Alcoholic beverages whose price was agreed at contract conclusion and delivery only possible after 30 calendar days with price depending on market fluctuations.

ANNEX 2

DELIVERY POLICY

Delivery Area

Jyoko.com delivers within Spain and internationally*.

In mainland Spain and Europe, deliveries follow the method chosen during the checkout process.

Shipping Time

Shipping time refers to business days from order processing to receipt. Except for force majeure, delivery in Spain is 2–3 business days by standard post, or 1–2 business days for express shipping where address details are correct.

Delivery time in Europe varies by country; in UK, Switzerland, Norway, Germany, Italy, and Portugal, it typically takes 5–10 days. For the Rest of the World (e.g. Argentina, Mexico, Chile, USA), between 7–10 days on average.

Preparation and invoicing time before dispatch of in‑stock products is shown on WEBSITE and excludes weekends and holidays.

An email is automatically sent to the CUSTOMER upon dispatch if the provided email is correct.

Delivery time and costs

During the ordering process, the SELLER specifies available delivery times and methods. Shipping costs depend on delivery mode and are charged separately from product price.

Delivery procedure

The package will be handed to the CUSTOMER upon signature and ID presentation. If the CUSTOMER is absent, a pickup notice is left allowing collection at the nearest post office.

Delivery issues

CUSTOMER is informed of delivery date at checkout before confirmation. Delivery will occur within 30 calendar days. If delayed, CUSTOMER may request delivery within a reasonable time or cancel the order.

SELLER will refund the full amount (products, taxes, and delivery costs) promptly after cancellation acknowledgement using the same payment method.

The SELLER is responsible for delivery. CUSTOMER has three (3) days to notify carrier of partial damage or loss.

Incorrect addresses

If delivery address is incomplete, standard post returns take 2–5 weeks in Spain, longer internationally. Jyoko.com is not responsible for return delays or costs of reshipment. Please ensure delivery details (especially last name and company field if needed) are accurate.

For express deliveries, ensure address is correct—reshipment costs due to address changes at carrier’s request will be billed to the CUSTOMER.

Expired packages or unnotified deliveries by postal service

Post often fails to deliver notice properly. Do not wait more than 8 days after our shipment email without claiming your order—POST will return the package after 15 calendar days, often without notice.

The CUSTOMER confirms by accepting these Terms of Purchase that second-shipping charges are accepted if due to incomplete or unclaimed deliveries.

Jyoko.com is not liable if delivery is prevented by circumstances beyond its control (supplier delays, fires, floods, strikes, power outages, etc.).
